A Pennsylvania judge declined to halt Elon Musk’s $1 million voter reward program, opting to wait for a federal court's decision on whether to take up the case.
During the October 31 hearing in Philadelphia, Judge Angelo Foglietta stated he would not push forward with the case against Musk’s initiative until the federal court weighs in. This allows Musk to continue offering $1 million daily prizes to voters who sign a petition supporting constitutional amendments on free speech and gun rights. The case, filed by Pennsylvania prosecutors, is unlikely to be resolved before the November 5 election.
Musk, who did not attend the hearing, was accused by prosecutor John Summers of being able to appear in court easily if he wanted to. The reward program, run through America PAC, targets registered voters in key battleground states and has already awarded one participant during a rally in Harrisburg on October 19.
The Philadelphia District Attorney’s Office filed a lawsuit on October 28, alleging that Musk’s initiative is an "illegal lottery" meant to influence voters. However, prosecutor Larry Krasner did not claim the program violated federal law. Musk has donated nearly $120 million to America PAC to support Donald Trump's presidential campaign and pledged full backing for Trump after the former president survived an assassination attempt in July.
Trump has promised to appoint Musk to lead a government efficiency oversight committee if he wins the election.
