Under federal law, states must transmit their certified electoral votes to the Vice President, who also serves as President of the Senate, by December 23. The Vice President will then preside over the session to certify the vote count. At the conclusion of the session, Harris will be required to officially confirm Trump's victory and acknowledge her own defeat by striking the gavel. This marks a rare moment in American history where a presidential candidate must certify their own loss and the victory of their opponent.
Harris has not yet commented on the event, but in her concession speech, she pledged to ensure a peaceful transfer of power to Trump.
On January 6, 2021, as former Vice President Mike Pence was presiding over the certification of Joe Biden’s victory, a mob of Trump supporters stormed the Capitol, disrupting the proceedings. The attack resulted in the deaths of at least five people, injuries to 140 police officers, and $1.5 million in damages.
Pence later resumed the session and certified Biden’s victory, rejecting calls from Trump to overturn the election results. Since September, the U.S. Department of Homeland Security has designated the January 6, 2025, electoral vote certification as a National Special Security Event, warranting the same level of protection as events like the State of the Union address and the Super Bowl. The U.S. Secret Service will oversee security planning for the occasion.
