Two voters from key swing states have filed lawsuits against Elon Musk and a super PAC backed by the billionaire, claiming they failed to select a recipient for a $1 million prize in a random manner as promised.
On November 5, Robert Alvarez, a voter from Michigan, and Jacqueline McAferty, a voter from Arizona, separately filed lawsuits against Elon Musk and America PAC, a super political action committee supporting former president Donald Trump. This legal action comes just one day after Musk’s attorney, Chris Gober, stated that America PAC had not randomly chosen the recipient of the $1 million prize.
In October, Musk and America PAC launched a campaign pledging to award $1 million to a voter in one of seven swing states who signed a petition supporting constitutional amendments on free speech and gun rights. Critics argued that the initiative violated federal laws prohibiting monetary incentives to influence voter registration.
On October 20, America PAC revised their terms, stating that the winner would be selected to "earn $1 million as a spokesperson for America PAC." The committee subsequently awarded 16 checks of $1 million each. However, prosecutors in Pennsylvania filed a separate lawsuit against Musk and America PAC, claiming the program constituted an "illegal lottery." During a November 4 hearing, Musk’s attorney Gober revealed that the recipients were predetermined based on their potential as spokespersons, rather than selected at random. A Pennsylvania judge ultimately refused to issue an injunction to stop the program in that state.
Robert Alvarez’s federal lawsuit in Michigan alleges that Musk and America PAC engaged in "fraud and breach of contract." Meanwhile, McAferty’s suit in Arizona raises similar allegations and seeks to establish the case as a class-action lawsuit with potentially over one million plaintiffs.
The suit claims that "had McAferty known there was no chance of receiving the $1 million, she would not have provided her private personal information, nor signed or supported America PAC’s petition."
Neither Musk nor America PAC has commented on these new lawsuits. In the 2024 presidential race, Musk, the world’s wealthiest individual, has contributed nearly $120 million to America PAC, making it a key player in Trump’s campaign efforts. Trump has pledged to appoint Musk as the Secretary of the Department of Government Efficiency (DOGE) if he wins reelection.
