The U.S. Supreme Court declined to intervene in a New York court’s sentencing of President-elect Donald Trump, stating the ruling posed minimal disruption to his role as incoming president.

On January 9, the Supreme Court rejected Trump’s request to delay a Manhattan criminal court’s sentencing related to charges of falsifying business records to conceal unfavorable information during his 2016 campaign. This is one of four criminal cases Trump has faced since 2023, including two federal cases in Washington, D.C., and Florida.

In July 2024, the Supreme Court ruled that Trump was entitled to immunity for official acts, a decision seen as a significant win for the president-elect. That ruling forced prosecutors in Washington and Florida to review their indictments. However, the court took a different stance this time, allowing the New York court to proceed with sentencing just 10 days before Trump’s inauguration.

Key Reasons for the Court’s Decision

Observers attribute the Supreme Court’s decision to two main factors. First, Trump retains the ability to appeal through standard legal channels within New York’s judiciary. Second, the impact of the sentencing on Trump’s current role as president-elect is negligible.

“Trump has full access to the appeals process within New York’s court system,” said Mark Joseph Stern, legal analyst for Slate. “Moreover, the effects of the sentencing on his presidential duties are minimal.”

The Supreme Court, composed of nine justices—six conservative and three liberal—issued a narrow 5-4 decision. Chief Justice John Roberts and Justice Amy Coney Barrett joined the three liberal justices, Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson, in voting against Trump’s request. The four dissenting votes came from conservative justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh.

The majority emphasized that the New York court’s sentencing would only require Trump’s virtual attendance, taking mere minutes and causing little disruption to his activities.

Limited Sentencing Impact

Presiding Judge Juan Merchan previously indicated he would not impose a prison sentence on Trump, opting instead for a lenient ruling. Constitutional law scholars note that even if a prison sentence had been issued, it would likely be postponed until the end of Trump’s second term, ensuring no interference with his presidential duties.

Stern described the Supreme Court’s decision as a “major setback” for Trump, noting the shift in support from Roberts and Barrett, who previously sided with Trump in the July 2024 immunity ruling.

“Roberts appears to shift his stance depending on who occupies the White House,” Stern speculated. “Under Biden, Roberts leaned right; with Trump returning, he seems to gravitate toward the center.”

Implications for Trump’s Legal Challenges

This decision is seen as an early test for the Supreme Court justices, who are expected to handle numerous legal disputes during Trump’s second term, including controversial policies on immigration and federal employment.

“The vote on Trump’s request was an opportunity for the Supreme Court to assert its independence, especially as Republicans prepare to control the White House and Congress,” said Stephen Vladeck, a law professor at Georgetown University, in an interview with USA Today.

A Historic First

On January 10, Judge Merchan delivered an "unconditional pardon," meaning Trump would face no prison time, probation, or fines but would still have a felony conviction on record. Trump will become the first U.S. president-elect with a criminal conviction to assume office when inaugurated on January 20.

Despite avoiding penalties, Trump expressed outrage, calling the trial a "shameful farce" and indicating he intends to appeal.

The Supreme Court’s ruling allows the appeals process to proceed through Manhattan’s appellate court and the New York State Court of Appeals in Albany. Legal experts predict the appeals process could take months or even years to resolve.
